All the judges do is interpret the law. It isn't the judges fault, lobby congress to change the laws. Legislation like tort reform comes up on the ballot frequently.

All the people saying you can sue anyone are correct--all you have to do is go to the courthouse and pay a filing fee. But unless you can prove the gun maker was negligent--like knowingly sold the gun to a mass murderer who said they were buying it to do more murders, winning the suit will be quite unlikely. Judges don't "let suits happen" They just preside over the suits that some person files. And you can't sue the judge--they have immunity from lawsuits for this type of thing. Actually, you can sue--see the first statement above. But the suit will end up being dismissed because of immunity.

I am not understanding.
You want to sue a gun maker because his loved one was shot and killed?
You want to sue a gun maker because a loved one of yours was shot and killed?
You want to sue a judge because he is hearing a case about one or the other?
In either case, you can attempt to bring suit against whomever.
But this has been before the courts before, and gun manufacturers have not been found liable because a gun they made was fired and killed someone.
However, if you live in California, only the 9th Circuit Court knows what the outcome may be.

The real answer to this question is no. Except in very limited circumstances you cannot sue gun manufacturer of dealers unless you can prove they were negligent. It's called the Protection of Lawful Commerce in Arms Act.

edit: Well you can sue then in the sense that you can file a complaint but it will be thrown out.

You can definately sue, you can sue for anything. Whether you will win or not is another question.... BUT if someone can sue McDonalds for serving hot coffee and WIN, you have a chance.

Liberal judges would love to help you out, they could go after the BIG gun companies like they went after BIG tobacco.

You can sue your cat if you want to. It doesn't mean you stand any chance of winning.
