and my daughter is getting disabilaty and she is not his, can the court count that as my income to decide how much childsupport he has to pay?

If she is getting disability, that should not be counted as income. Child support, disability, and SS benifits are not taxable income, therefore should not count as a source of income and should not even come into play in the charges against the father of your son.

Your daughters disability income should not factor in because that money is for her and her care, not your son. The child support should factor his fathers income and go from there.

They count his income when making the decision. Did he adopt the daughter? If so, she is also his financial responsibility.

His income is considered usually, not yours.

disability is never factored into child support, because it is suppose to be used to help you child access needed services.

well it is income, if they dont count it, they should be.
