The modulator only controls the 1st kickdown(from 3rd to 2nd). I think you have some other significant trans issues. The unit can leak from several point other than the gasket.
- input shaft seal
- output shaft seal on both sides where the axles connect.
- speedometer mount
- shifter shaft seal
- and the modulator mount point
given its age, it may need replaced, not sure of the mileage though. You may be able to get the bands adjusted this may resolve the problem for a while.

Maybe your filter didn't seat right and now fluid is leaking past the seal so your transmission isn't getting enough fluid to work correctly until it hits a higher RPM and can overcome the internal leak. Now for the leak outside the transmission it can come from the output seals and from the input seal. the output seals are difficult to replace as you have to remove the halfshafts, and the input seal requires the transmission to be removed. Try taking the pan off again and making sure the filter is in correctly and as for the external leak, well just keep some fluid handy or be prepared to pay at least $300 for the output seals and a lot more for the input.... also there is no modulator it is electronically controlled, look near your throttle body(where the gas pedal wire hooks up) and there should be another line that is connected that controls the transmission this can cause no shifts or high RPM shifts as well.

nicely i might take it returned to the shop they in all probability did no longer tighten the bolts precise the two to lots or to little there's a torque spec for the transmission pan additionally make the constructive the fluid isn't over filled too this you may examine your self start up the automobile enable it heat up discover the transmission dip stick eliminate it whilst the autos working wipe the top sparkling then positioned it returned in then eliminate it returned see it its on the finished or warm line.

Bring this in and have the trans checked on a computer machine to figure which module it may be.

It could be just high miles and wore out clutch pack seals
