Some people are so literal minded! sheesh. Of course the song you refer to was played by Charlie Daniels. And no, the Devil had no real part in the song. Since "The Devil" is a fictional character, I seriously doubt there is any trading standards infringement.

The devil is a much better guitar player than a violin player. The Charlie Daniels band did receive the necessary releases for the Devils production company.

what many people don't know is that "The Devil" was delayed in traffic the day this song was recorded...since everyone was in a time crunch, the producer of the song spliced together snippets of "The Devil" rehearsing the day before...rumor has it that "The Devil" was cool with everything until Charlie Daniels quit performing the song altogether...but since the statute of limittations have expired, there's nothing to be done here...

The title of the song uses the PAST tense "went" so it is inferred that a story is being told of a previous event. It is also assumed that not all (or any) of the actual attendees of the former event are present.
So sit back and enjoy the tune.

Johnny might have won the fiddle made of gold, but the battle wasn't over. The devil wants Johnny's soul, and if Johnny keeps entertaining the devil ... he's eventually gonna lose.

You're all wrong. The Devil's part was actually played by the toothless hillbilly from 'The Deliverence'. He had no credit on the song as he waived them for a sack of carrots.
