My neighbor has very big overgrown trees that hang into everybodys yard. We have a pond in our back yard and the leaves keep pluging up our pump. We clean it everyday and we have already had to replace it. It is not cheep. I need to approach my neighbor but I want to know what the rule of thumb is before I do this. I know I can cut anything over my fence but there is still a mass of leaves. It also sheds some kind of little things off it which make a bigger mess in our back yard.

Any tree on your property is your responsibility and like wise. But you'll have neighbors who won't be willing to cut the side of the tree that they have to pay for because most people are cheap as long as it's not botheing them it can hang over where the tree wants. I would definitely approach the neighbor with the offer to finance the total trimming of the tree and gently tell her/him about the clogging of the drain. Although many neighbors won't care about your pool problem. Take photos for sure of the mess and the leaves. Consult with an atty also. Good luck.

In most places that is governed by local laws. Check with your town's zoning department or building inspectors. They can point you in the right direction.

Where I live there isn't much you can do UNLESS the tree is causing problems. You would have the right to have it trimmed back to your property line and if it caused damage to your property your neighbor would have to pay for the work. But that is HERE.

Grab the phone book adn call the town/city and get the number of the department that deals with such things. States don't get into those kinds fo things except on a level of safety such as swimming pool regulations.

If the tree is hanging over onto your property, your have the right to trim it without his permission. The right thing to do is go to the neighbor and speak with him, but you don't have too.

ask the neighbor to trim the tree back...and if they refuse...tell them you will be trimming anuthing hanging over your fence.
