My ex-husband has made a false child abuse report against me?

I got the police report of which the allegation was unsubstantiated. Now I'm battling with him on custody and need to proof to the court that he made the report with malicious intent. How can I get the identity of the person reported the case ? With Sheriff or DCF, my attorney isn't doing anything on this issue.

Hopefully you will understand my reason by the end. The person filing this report should be on the report. If you take this up in court on your own, you may be iniatating a hostile divorce. Rather than get revenge, let him hang himself, use this report as proof if he brings up the fact that you are an unfit mother. Unless he can prove real evidence proving child or drug abuse, the court will award you custody of the children anyhow, thus the need not to open a can of worms. If he does bring this up in court, hes hoping you dont have a copy of the report and at this time only, you can tell the judge your story and report making him an *** in front of the judge and makes you an angel. You would have known long before this if his childish games would have hurt you.I dont see that. You just dont want to end upplaying little kid games with him. Let him hang himself. No offense, i dint know the whole story, but in my experience you just cant call the police and file a report. They come out and investigate. There must have been something legitimate to tip off the police to do the report. My experience was with a domestic abuse stuff and not child related but the cops do look for proof when they do the report (marks, scratches, child telling them). I would find out what tipped this off. I would also find another lawyer!

Can you get a statement from the officers and take this to the DCF hearing? Plus get documentation from anybody that you can think of to show you are a fit parent. Teachers, neighbors, parents of the childrens friends, church, even family members can support you.

well, actually i would think that the court would look at all the evidence including how you are as a parent etc. try to get your family or trusted friends to say something on your behalf but history should show whether or not you should get custody or not. These things get very ugly. Try not to stress but focus on your kids. At this time, they are probably as confused and upset as mommy. Take care. :)
