Yes I agee that she should have been found NOT guilty by reason of insanity. She's mentall ill. She will probably NEVER walk the streets again. She didn't get a "get out of jail free" card." She's basically still in prison. Has anyone ever been in a mental institution? You're locked in, you can't go anywhere....it's basically a prison in disguise. She's not free, believe me. The only difference is that now she will get the help that she needs. WHen she starts getting better and can process what's she's done to her kids....that's the REAL prison.

I agree that she should have been found not guilty by reason of insanity. I think that she needs to be at a mental hospital for a long time maybe the rest of her life. I mean she is mentally ill. She had or has voices in her head and I don't think she is better now. I think it was a good verdict.

I recognize that Lithium stare from seeing my cousin on that drug. She has all the mental power of a bowl of oatmeal.
Seriously though, if anyone was to be found not guilty by reason of mental disease or defect, it was Andrea Yates. She had a decade of documented mental health problems, several hospitalizations, and had been warned that having further children would put her at almost certain danger of another episide of post-partum psychosis. I hold her husband as accountable as she was. He had been told not to leave her alone with their children, yet he chose to leave her there with them alone that day. He was told they shouldn't have further children, yet he chose to follow God's will rather than medical advice. She was not competent to make these choices, but he certainly was. I hope he can live with himself.

I agree with Rose, I feel that Andrea Yates should have been given the verdict of Guilty but insane. She planned the murder previously. Anyone who can kill her children IS insane, but that does not absolve her of punishment.

Yes. Cancer is not always terminal- & neither is mental illness. Some people DO recover. I doubt VERY much that she's gonna get out of the hospital any time soon. But no matter WHAT happens- she will NEVER forget what she did to her family. -And THAT will be the real "punishment" that she will take to her grave.

she killed her own children. the trial was to determine whether she did did this or not and she did. I don't know how saying you were crazy means you didn't do something. I think it should be changed to you are guilty, but you are crazy so you are going to a mental institution instead of jail or prison for the same amount of years you would have gone to jail/prison.
I don't know why she got a second trial.

I don't know about insanity, but how the hell can you drown all 5 of your 5 kids and NOT be put to DEATH????? She KNEW she had post -partum depression, - SHE WAS WARNED BEFORE SHE HAD THE LAST CHILD!!! and refused to be medicated, or whatever the story was- I refused to watch the trial and and am from Houston. I just couldn't do it. I think she should have gotten the death sentence.

In some states jurors have the option to find someone "guilty but insane", which seems more appropriate in this case.

Screw her she should have fried in the chair. Its funny though because you make it seem like she has it easy now. I dont think so, she will still be locked up, not able to do anything. Its a mental institution.
