Stay on top of your insurance company. Make sure that the body shop and the adjuster are on the same page. Stay on your agent through the subrogation process to ensure that you get your deductable back.

Contact your insurance company. They will need three quotes for auto repairs. If there is bodily injury you should have your medical paid -- your insurance company should help with that too. If you're looking to sue simply because it was an accident they now have laws against frivolous lawsuits so make sure you only ask for your losses and documented compensation.
