i have a feeling they are. last night i sent about 20 texts to a friend around 12-1AM and i went and checked my account online and it tells me my recent calls and texts. Everything's updated, like my recent calls, but my texts say the last time they were used were at 5:25PM which is right. I didn't text anyone after that time until 9PM.

Tell me if it is free though.

You want to check what text messaging package you have, because generally speaking, texts are not free during off-peak hours.
Even if you did have some type of text package that offered unlimited texts, they still would track the fact that the text was made, and they would just put a $0.00 next to the text.
I used to work for T-Mobile, and the way their account tracking system would work is phone calls were updated immediately, and texts would be entered into the tracking system later. Usually big phone companies will use similar software, so that may be the case for Verizon.
I would go call Verizon and see if they do offer a text package that does offer free texts after 9 pm. If you're afraid that Verizon may be making a mistake to your benefit, and you don't want them to catch it, you could always look up the 800-number, and call them from a landline phone. When you call, just tell the rep that you don't want to give your number, and you just have a general question. Usually the rep will help you out.
