If someone stopped at a small gas store and was assaulted-robbed, beaten, stabbed and thrown in a dumpster until he woke up 2 hours later-----(In Texas)...Can you sue the store owner?
The victim had to have surgery and stayed in the hospital for a week.

Whoa.....My husband along with a lot of other people stop at this store because it is open early in the morning.
He was attacked when he was getting in his truck. Severly beaten and stabbed.
The store owner has had problems before.
Unknown to everyone is that the area is a 'hot' area according to the police.
Wouldn't you think a store owner would notice that a truck hasn't moved in over 2 hours??? I think businesses has a responsibility to their clients. As someone said---if this happened on your personal property, you would be sued. Someone robbing your home can sue you for attacking them if it is outside the house.
I am not asking because I am out to get the store owner. How would you feel if it happened to you? They will never catch the idiots, because they are bums-literally...... You can't sue someone who has no means of support.....

Why would you want to sue the store owner??? It wasn't his fault. Focus on getting justice served and find the person who commited the crime. People are too "sue happy" these days. Why ruin someonelse's life based on what another person did. Doesn't make sense.

You MIGHT be able to sue him. But why would you? I mean, if someone broke into YOUR home and beat up your houseguests and robbed them, and also robbed you, how would YOU feel if your guest then proceeded to sue you?
It's understandable that you are upset and need somewhere or someone on which to lay the blame...but really think about it...was the store owner in any way, shape, or form responsible for what happened to your husband? Stores do get robbed...that's why robbing a store is a crime.....it DOES happen.
You can only be so safe....it IS possible to be assaulted and robbed at any place that does business with cash registers.
It's one of the risks of living life.
I hope that all works out for you and your husband...and I hope you will both get counseling to get you through any post traumatic stress disorder you could be experiencing from this incident...and I hope you will cut the poor store owner some slack and focus on the schmuck who actually committed the crime.

Welcome to America! In our litigious society, anyone can sue anybody over anything. You will have to convince a judge or a jury that your reason for suing has merit. If an old bag can sue a fast food chain because the coffee was too hot, I think you stand a chance. Say that the attendant at the station was negligent for not summoning help in a more timely manner.

Theoretically the store owner is liable. Or more accurately the Property owner if the store owner is leasing. A property owner of a business has the responisbility to protect people entering his property from harm.

You can't rightfully sue the store owner but you can sue the person who robbed the store.

This is America. People sue because their coffee is to hot. Some crafty attorney will find a reason to sue in any situation.

It does indeed depend on who did it. Was it the owner or an employee? If it was an employee sue the employee..however ask a lawyer on what his best advice would be.

the victim should be able to sue the store owner, you can sue a homeowner if you get hurt on their property, it seems the same to me!
