Congress has the ability; however, a few times in history the president has used his power to declare war before having it passed through congress. Or put it this way, the President won't call it a war, but it will be somepeace keeping mission or something.

It's supposed to Congress, but President Bush kinda broke that rule when he declared war despite Congress not backing him up.

Officially, only Congress can declare war. Of course, when you have an idiot like Bush, he just asks - on behalf of Cheney and Rumsfeld, his puppetmasters - for Congress to let him send in troops without an official declaration. The Iraq War has never been an officially declared one.

congress, still the executive can wage or declare the U.S. is at war----like President Bush which is why people got upset at him for going to war in Iraq. Hope this helps.

the president declares war since he is the commander in cheif of the armed forces but it is congress who votes on wether or not the country is officialy at war
