Depending on what state you live in, you might be able to petition the court for a "withdrawal of guilty plea and setting aside of the verdict." On the web, you can search for your State's law page (Codes and Statutes) and from there you should be able to find if your state has such a Statute, and what proof you have to present to the court (generally that you have not had any new charges in x amount of time). Then the charge will be removed from your record. Otherwise, I think it will always be there. The amount of time you are thinking about applies to if they can use a previous conviction as an enhancement in any sentencing in a new crime, i.e., second domestic assault within 3 years...you can also find out how long your state holds previous charges as chargable offenses on their website. Or type into your search engine something like "how do I get a charge off my record in (your state)" and it should come with something to get you started. Also, you might think about leaving out this information on your applications. If they don't run a check, then you might get the job. Sounds dishonest, but if it was a bogus charge, I don't think it's that big of a deal to leave it out.

it doesn't go away unless you pay a lawyer to get your record of that case purged...if that's legal in your home state.
Under some newer liberal sanctioned law ( Lautenberg act ) you now cannot own or posses a firearm or CCW. even though that law violates the second amendment
