If he's parked, and you're moving, you are at fault. You are supposed to do what a "reasonable person" would do- that is, walk around and make sure when backing up that you can SAFELY drive out.
Just think how bad you would have felt if you had run over a 2 year old toddler and killed him? Its happened- just FYI

Most likely. Your insurance company will decide who's fault it is. But you should always check for anything in your way, when exiting a driveway.

Depends on your local law, but my guess is 100% yes. The fact that it was on your property does nothing to exempt you from liability.

if you hit it it is your fault. did you have the police out
to check it out? your insurance might get ahirty about
paying if you didn't.
