Here's the deal:
My friend knows his wife is cheating on him. He has proof. They moved here to NC from California 6 - 8 months ago and have been staying with his mother. They never signed any kind of lease agreement with her, just had verbal agreements about bill paying and helping out and such. The only catch is, his mother rents the house they are staying in. They kicked her out yesterday. She had a friend come and get her, and stayed with that friend for the night. She calls him up today telling him that because she is not more than 30 days behind on a rent payment, and hasn't been served formal eviction papers, that they legally have to let her stay there 30 more days. Anyone know anything about this, and what could be done?

Sorry, by saying "they kicked her out" I meant my friends Wife, not that his mother got kicked out.. lol

Yay for details.. another note - my friends wife is saying that because she recieves mail there, that makes he as much of a resident at that address as my friend and his mother.

If there is no lease agreement, it is on a month to month basis. Call the local housing authority and find out what the landlord's rights are.

Well I would call the police department and ask them because they don't have a written agreement it might not matter if they kick her out but its a good idea for them to get eviction papers that why there wouldn't be any problems and she couldn't take them to court or anything but i would call the local police department if i was them

Your question is a bit confusing. So the mother got evicted because of non-payment of rent, but the friend and his mother want to evict his wife? I'm lost.

He should let her catch him having sex with his mom...that will make her leave.
