I didn't sign a lease but after I gave the deposit and the landlord cashed the check, I asked a bunch of questions and he said that I was too difficult. Now he won't give me the apartment but is going to give me my check back. Can he do that?

In most states, the law allows him to give you your money back if you haven't signed a lease yet. Unfortunate but true.

Depending on what your local statute says about landlord/tenant law he may be able to keep your money. Was this part of an application fee? Call your local legal aid and they can be more specific and even assist you with the process.

Yes he can give you your deposit back. He does not have to rent to you as long as he has not discriminated in any way. Race, creed, religion, familiar status. He can refuse you for being difficult.

Yep. He can decide to not rent to you just like you can decide to not live there. If you don't get the money back you can sue him in small claims court.
