After going to debt counseling,I had no option left except to file a chapter 7. Listed with my debtors are 2 payday loans,2 weeks prior to filing,I took out a payday loan for $175,yes it was stupid, but food on the table seem more important at the time.I called and informed them, that I had to retain a lawyer, and was informed that when I signed the contract I would not be filing bankruptcy within 30 days, and my attorney was a personel friend.I did not plan on filing, all other options were used up.Can and will this effect my bankruptcy? Also, the 2nd payday loan I borrowed from is a prominent member of the community, and told me he would get his $ one way or the other, even if it ment following my butt all the way up the court house steps.I am a emotional wreck! The stress of the bankruptcy has taken it's toll, and now this.I will call my attorney on Mon.,but if anyone could help relieve some of this emotional roller coaster,I would deeply appreciate it!

I wouldn't worry about it. Try and calm down. Of course they are going to put pressure on you. They want their money. They are hoping you will just pay them to get rid of them and forget about including it in the bankruptcy.
Let them follow you to court. The court will decide if it can go into the bankrupcty or not.

One of the great things about bankruptcy is that the debtors by law are no longer allowed to contact you. They can only contact your laywer. So, if they keep harassing and bugging you, they themselves are the ones that will find themselves facing a lawsuit, not you. If they contact you, just say, Please call... and give them the lawyer name and number. Then call the lawyer and let them know you were contacted again.

Just remember that they are only debt collectors.. They can't do anything to you. They are just trying to rattle you and it is working. Just ignore their threats and remember that your lawyer is there to handle them.

Good Luck!

If anybodys threatens you to get money, then its against the law. any bill you list that you want in bankruptcy will be included. Tell your attornry that you were threaten because he know the law.

My brother didn't claim bankruptcy but the creditor from his car loan threathen him to get money and he was able to get the bill off his credit because he broke the law.

once you claim bankruptcy they are not suppose to bother you.
