Since the term 'artistic merit' is so subjective it would be impossible to define. What I see as artistic, you may see as absolute rubbish and vice versa.

No, I am a playwright and I submit scripts for copyright all the time. They all suck and have not artistic merit. But I still want them protected. So it should just have to be original.

No. If you create it, then it should be yours. A judgment of artistic merit should not apply.
