Is your son charged as a juvenile or as an adult?

If he's charged as a juvenile, your assets and income, and that of his father (if you two are still married or the father has joint legal custody) will be considered if you ask for a public defender. If your assets and income are too high for a public defender, you'll have to come up with a way to pay a private attorney. Perhaps you could get a second mortgage?

If he's an adult, his income and assets will be used to see if he qualifies for a public defender. He needs to ask the court to appoint one for him.

To get him out of jail, see a bail bondsman. You'll have to put up about 10% of the bail amount in cash.

What was he charged with doing?

Does your son not have a court-appointed attorney? Also, be more specific about your geographical region.

He should have an attorney appointed to him. They should have told him that when they read him his rights.

They will appoint him an attorney if you can't afford one.
