There is a situation where a couple of tenants at a housing complex is disrupting sleep with loud music, littering on the property and the landlord has been informed but is not acting on the information. The tenants being disturbed would like to petition the managment company.

The police have already been called on numerous occasions, the landlord already spoken to, the tenant also, he's trying to intimidate me, I want the landlord to do something. He not only disturbs me but also the tenants surrounding me. I need to know how to start a petition so that the landlord will make the next move. I can continue to call the police and will, the tenants stops the annoyance and then comes back once they leave. The problem remains.

Keep a log of the exact dates, times and nature of the disturbance, if the police were called, etc...

If you all band together, you will be much more effective. An organized and cohesive approach is much more effective than a bunch of lame phone calls.

Send the landlord a copy of your log(s) via certified mail and give the landlord a period of time to cure the situation. You have the right to quiet enjoyment. Remind them of this. Tell them that you will all withold rent and place it in escrow until the situation is fixed. Have each individual sign the letter. This will show that you are serious.

If he takes all of you to court for non-payment, you may be able to ask the court to hold the funds in escrow until the situation is resolved.

I'm sure the landlord will have some sort of remedy available to him (or her) in order to evict a tenant who is so disruptive. The exact law and procedure is different in every area, but your landlord can resolve the situation.

Have you all tried filing complaints in municipal court against this other tenant?

If you haven't expressed your concern to the tenant then do so. Usually landlords don't like to get involved in disagreements between tenants. I would say something again to the landlord and let him know you're just giving him a heads up on it. Maybe ask him what his policy is regarding this matter. Don't hesitate to call the police and report a disturbance. Eventually they will get the point. But regarding your petition matter, I don't believe there's much that will come of it.

I agree with Bostonian. If you continue to call the police, they will be in touch with the landlord. From a landlord's perspective, you never want to have constant complaints to the police regarding your property.

Keep complaining. Call the police any time they disturb the peace. The squeaky wheel gets the grease!
