Although I still wanted children, I agreed to a vasectomy because my wife claimed that her life or the baby's life would be in danger if she became pregnant. We later divorced and my new wife and I have reversed the vasectomy and are trying to get pregnant. Now my ex just had another child. Can I sue, and what damages could I seek?

Although I still wanted children, I agreed to a vasectomy because my wife claimed that her life or the baby's life would be in danger if she became pregnant. She even had an abortion so she would not carry another baby (by me) to term. We later divorced and my new wife and I have reversed the vasectomy and are trying to get pregnant, but have been unsuccessful in 4 years. Now my ex just had another child this past month. I am unfertile because of her, must go through surgeries, medical procedures, medications, not to mention the trauma of knowing I had the vasectomy for an honorable reason that never really existed. I can prove that she lied through her medical records and her actions -- bottom line, she caused a mutilation to my body and I may never be able to have another child because of her. Can I sue, and what damages could I seek?

Here in Australia there are penalties for women who decieve a man into having a vasectomy through lies.Some of the things they can be sued for are mental stress mental anxiety and phyisical abuse through decievement.

Maybe ... but it would be very expensive and time consuming.

And it certainly won't help your case that you never took reasonable steps to verify her story before willingly undergoing such a drastic procedure. It doesn't sound as if you used even the tiniest amount of common sense in your situation.

What do you hope to get from her? Are you willing to throw away thousands and thousands of dollars and years of your life into
pursuing a claim against her? Are you willing to carry the emotional weight of this whole thing hanging over your head? What if she files a counterclaim? Do you have unlimited funds with which to pursue this matter until the end? Does she have assets? If she does, will there be anything left for you to collect after she pays her legal fees and expenses? Do you have any proof that she said any of what you claim? Do you know for a fact that she hasn't undergone some sort of corrective procedure?

I'm sorry that you were lied to, but there has to be a point where self-preservation sets in and you don't allow yourself to undergo medical procedures without checking out the facts of the matter first.

If you are really set on this, make an appointment with a lawyer in your area to discuss the matter and get their honest opinion based in their experience.

Good luck in having a baby with your current wife. I know from personal experience how painful infertility is.

First of all. . . just be glad you didn't have any children with this woman. . . take that part of it as a blessing. Now. . . the reality here is you are a complete moron for getting duped by this lying whore of a woman. There is no way you could sue her in court as the motivation for your vasectomy would be he said she said with no concrete proof. Because you were so stupid and such and idiot. . . I myself thank your ex for doing what she could to ensure your moron genetics were eliminated from the gene pool.

Of course you can't sue her! It was YOUR CHOICE to have the vasectomy in the first place...no matter what she told you. You were the one that signed the papers for the doctor to perform the surgery. Now that it's reversed, give yourself time to shoot with live ammo again...it is possible, it does happen.

I guess you could sue.. however whats the point.. its in the past. She lied. End of story. The outcome wont change a thing. Might make her pocketbook a bit smaller and yours a bit bigger, but the facts still dont change. Just go on with life.

Don't worry about what happened in the past! Both of you have moved on to diffrent lives now. How are you going to prove lhat she lied to you anyway? It would be your word agianst hers! Maybe she did not want to have a child with you!

I say just get on with the life you have now and don't worry about the past!!!

vasewctomy is not a one way operation. ask yr doctor to reopen it for u.
