Check out the employer liability insurance. The chances are that most do not allow smoking in the work place. If he is infringing then the company will not be covered - that should frighten him. I do feel a bit sorry, though, I'm a smoker myself - but don't do it in the work place.
Also, a previous replyee (?) was right - if it makes you feel ill it is a health and safety issue - check it out with the H&SE. My boss just swears a lot and screams and shouts - reckon I prefer the smoking bit. Stress issue both ways.

I always thought it was illegal in America to smoke in public or enclosed places - I was obviously wrong. However, it would be a good idea to talk to him about passive smoking and the dangers it carries. I smoke but would never smoke in my office anymore as it is illegal and inconsiderate to non-smokers. You will have to be tactful though as he is your boss. Good luck.

I know in California there is a state law no smoking in any public building of any kind, or any office building as well. I thought it was a federal law, but I guess not. I guess it's state by state.

Have to tell him it bothers you first and pick the right moment be nice maybe suggest a suitble room he and others can use where you can close the door and open windows.
The law has changed if he fails to change then contact HR Department for further advice.

You would have to check with you local laws, but in general, smoking in public places is a no no. Even if in your area its legal, you can still complain if it is making you sick, and or uncomfortable in any way. You do have rights.

It`s definitely illegal in Oklahoma! Especially a place of business. Most restuarants and some bars are the same way "unless" they have proper ventilation.
You need to check the laws in your location.

Not sure where you live, no don't know what the law is there, but in New Zealand where I live it's definitely illegal. In fact smoking in any enclosed public place illegal here.

It depends where you live.
In Australia (NSW, VIC etc.), it is illegal to smoke in a workplace with other non-consenting workers etc. and is also an OH&S issue. They can be taked to court.
