I live in KY. I have been seperated for 6 yrs. My so-called spouse
is in prison in CA. I finally tracked him down, but I want to serve
him papers, but I don't want to waste more money, in case he
gets out. Then I won't know where he is again....What do I do ?..
The prison officials will not tell me when he gets out, nothing.

For one, prison inmate info and release dates are all available online. All you have to do is look up the State Inmate Data Search

for california, you should be able to find out all the info, including prison inmate number address ect.

The particular situation you present is covered in the California statutes and there are some things you can do. Start by searching and u can use yahoo, california law. The website is california statutes and covers all 29 codes for the state. An additional search within the codes will tell you how to deal with the out of state situation and the papers that are necessary for you specific circumstances. A consultation with an attorney, most times is free and they can at least point you in the right direction.

This seems to be a problem. Contact your ocal court house, you may be able to file your own papers without getting a lawyer. You can buy the kit at Office Max. There are states where you can file for divorce and just run a notice in the paper for 14 days to give him a chance to answer. I say since you don't know when he is gettingout, I would try to go that route. Then you don't have to worry about finding him. Also, depending on how long since he left you to the time he was locked up, you may be able to file for divorce on the grounds of abandonment

Get the divorce while you still know where he is. It'll be worth it. Then you can get on with your life. Like you said, if he gets out you may never be able to track him down again.

Get to a lawyer fast. He will know how to handle this situation. You will probably need one anyway since you are both in different states. Hurry while you can still find him.

Have him served in jail...one of my co workers did that while he was serving time for assaulting her. His information is public knowledge...unless he's in a state mental institution. If you could, please tell me which prison.

Your attorney should be able to help you with these issues..if you don't have one..get one...you have complications and need a professional to represent you.
