My case is not actually filed yet because my Att. fees are not yet paid in full. I cut up all credit cards on the day I went in for a consult. I did not charge anything after that day but I have and did I shop with my debit card. I now only buy the absolute necessities. I may not qualify for Chapter 7 because I still have between $200-$300 left over after all expenses at end of month so may need to file for Chapter 13. This left over money (all of it) would go to pay my reorganized debt, but if any emergency were to happen I don't know what I would do. My doctor just took me out of work for a month due to excess strss/anxiety/fatigue. So now I'll miss a month's salary. This medical situation is not a shocker, it's been a bomb waiting to explode for a long time and it finally happened - mostly because of work related stress. (I am a single 30 year old Flight Attendant) I do not know what to do at this point in regards to my financial situation. It seems to be a downward spiral. HELP!

Just press the Chapter 7 issue with your atty, tell him your job related issed with being off work for 1 month and tell him you don't really feel you could afford to make a monthly payment everymonth, cause you don't know how stable your finances will be in the near future. Maybe you need to consider finding a less stressful job. Its not good for your health, and you are still young enough to start a new.. I hope all works out well for you.. I know I have been there done that. I went Chapter 7 14 yrs ago, they wanted me to go Chapter 13, and I told em no way.. good luck

The 1st time I filed I talked to my lawyer about 13 but she recommended 7 to get rid of the debt completely. I did since I had
no house or car to lose. I unfortunately got more cards and ten years later filed again. The second lawyer told me my case was open and shut since I had nothing for the creditors to repossess.
Of course this was all before the new laws took effect so you
may have to pay some back. My best advice for the future is to
stay away from credit cards and pay with your own money, layaway the item or just do without it. Good luck.

You may not be bankrupt at all. You may be having a bad year. Financial strain can mess with your head if you don't have a plan. If you file bankruptcy and don't have a plan, you can end up in a worse situation. Try Financial Peace University.

Contact Dave Ramsey's office to determine if you are really bankrupt. If you are not, he will give you some clear direction, and could save you attorney fees. If you are, he can help you reorganize your life so you won't be in this same dilemma five years from now.
