When you retry from the nearist restart point, does it count as a death?

in the middle of a level, if you totally mess up, there's a retry option without dying. I don't like having deaths =)

Yes. When you select Continue from the You Are Dead screen, it counts as a death on your end of level and end game status. If you select Restart from the start menu, then your status isn't affected.

If you die and choose "Continue" or "Retry" (I forget which), then yes, it counts as a death. If you just reset the system or pause and choose "Retry" and start from where you last saved, then no.
