My roommate owes me over $450 in utilites for the past three months, but he has paid his rent. I have been paying all the utilities and am now broke.
My roommate has lived here for over a year and has never cleaned the bathroom, vacuumed or mopped the floor (and he wears shoes in the house despite my constant asking him not to).
He leaves the dishes he has washed just lying on the counter (this drives me crazy, I know it seems like nothing, but it is compounded by the other stuff).
He has a cat that is constantly coughing up fur balls, and he does not always clean them up.
And this drives me absolutely crazy, he hardly speaks to me. I can be in the room when he comes in the house, and he will just walk past me like I don't exist.
So essentially I have become a servant and a bahk. I am sick of it, and I want to kick him out, but I am unsure what the laws are.
Only my name is on the lease.

Well as I have said in many of my answers to others is he does this because you have allowed him to but now you've reached your breaking point.
You need to tell him just what you've stated here and that you need a responsible roommate and have someone coming to see the place in 2 days. Since he is not on the lease you are not required to give him any notice. Give him until the end of the weekend to get out and if he's not out then you may want to just pack up his stuff and put it outside for him. You have sent him a message of "it's ok for you to disrespect me and my home" and the damage is done. Now you need to take control and lay down the law. If you don't want him there then kick him out - it's that simple (and that complicated). I know it will be hard but just try to come from a place of what you will and will not tolerate and don't say things like "you this and you that" because that will just create drama. Just use the "I" statements like "I will not live this way" and "I need someone responsible here because it causes me too much stress to worry about the bills" and "I need someone who pays their bills on time" and so on.
If he is not on the lease, he has no rights. Period. Best to you.

If only your name is one the lease, then you just tell him he has however many days to vacate the house. You are done dealing with him, and he owes you past utils. Then you find a new roommate and you are pickier. It is best to have roommates on the lease to insure half the utils are paid, but it is your choice. You could take him to small claims, but iwthout a contract, it would be hard. And unlike what everyone said, you do not have to evict him thru the court. If his name is not on the lease, he has no right to be there once you tell him to leave.

Since your name is the only one on the lease, you can kick him out at any time. Personally, I would write him a "kick-out" letter and leave it for him in his room with a definite DATE in which he and his cat need to be out of the apartment. I would give him one week, and nothing more. The more time you give him, the more time he has to stew about it and possibly do some things before he leaves to get you back. If he is not out in one week, I would call the police to come over as you and some friends haul his stuff out of the apartment and place it outside. Good luck!

Well I would tell him that he needs to pay you all of his share of the utilities by next time the rent is due and well if he doesn't talk to your landlord and see if you can temporarily change the locks one day when he is out and do so.... it is your house and if he is not going to be an equal in the apartment. I would also have the police on hand in case it get ugly.....

only your name on the lease? Well thats an easy one he's gotta go. If his name is not on the lease he has no legal right to the place even if he paid for rent the whole time. Unfortunate for him but true. So tell him to get to steppin, and your life wont be so stressed, and tell him to take the furshooter to.

I would say if only your name is on the lease you have every legal right to kick him out. First, politely tell him that you want him to move out and explain why. Give him a reasonable amount of time to get out and if he doesn't leave, involve the police. Good luck.

you move out.
Unless you are listed on the lease. If you are both on the lease you are out of luck. If only you are on the lease you can actually evict him, but you need to do it properly, following every single letter of the law.
You definitely should stop paying for this guy.

You will have to go to the courthouse and get a 30 day eviction notice. That is the only legal way.

If the lease expired, give him notice that you are move out, and ask him to do the same. Sound like he does not like you, so move somewhere that he can not find you.
If he moves and you stay, he may come back and do something.
Play it safe.

Pack up his stuff, place it all outside, and have the lock changed on the door...only after you let him know you are going to ask him to leave if he doesn't straighten his sh*t out. If he doesn't, then do what I suggested in the first sentence.
