Well you asked, so I hope I am not spoiling anything for you. THe current person pretending to be Daredevil is Danny Rand, Iron Fist. I do not know if you have been following it, but this was revealed in issue #87. (I was hoping it was going to be Foggy...)

The original speculation was that the new Daredevil was Hawkeye, believed killed in Avengers: Disassembled. Marvel actually encouraged this speculation and joked about it repeatedly.
The new DD has since been unmasked - Danny Rand, aka Iron Fist, and old Marvel hero with unsurpassed martial arts skills and the ability to focus his powers into one devastating punch (the iron fist). You can read more about this at the link below.

I didn't know that Matt was in jail! How did he wind up there? he's a LAWYER, for cryin out loud! you can't put those guys in a cell even if you catch them standing over a warm corpse with a bloody knife in their hands!
Can't he make bail...? Did he actually get convicted of something...?
Spider Man is one of the few I know who would have the skills and chutzpah to possibly pull off an impersonation, to keep DD's ID secret, or to provide false evidence that Matt was not the one who was dong all those things while wearing the DD suit. But I don't know if Matt would go for that.
