I loaned my (really nice) flute to my (now) husband's friend in college for a woodwind class. I never see him, but I know he's a DJ in the area, so I know he's accessible. It's been almost 10 years and I want it back to teach and to give to my daughter. My brother in law has seen him since and reminded him and gave him our number, but nothing ever came of it. Should I hunt him down at a club or should I just file something in small claims court? Thanks!

Loaning something to a friend is called a deposit of a thing in Civil Law wherein the person benefitting from it should return it when requested by the owner. Thus, just request your friend to return it. Otherwise, you can file a complaint for its return.

If it's been 10 years, he might not even still have it. I'd go confront him yourself first, and then it nothing comes of that go the lawyer route. Good luck, and I hope it works out for you!

try actually talking to him, it would be insane of you to pursue a court case without at least trying to get the thing back in person.
