However, he does not want me to incur the medical bill debt. I work at a very,very, small private school and make just enough to cover rent. No more, no extra. If we get married and I incur the debt, would we be able to claim bankruptcy as a couple? The disease is disabling, he more than likely won't be able to work. I have no assests other than a 14 year old car that is probably only worth $200 for the scrap metal. Any advice would be appreciated. IS there anyone I could call that could advise for free?

Depending on where you live, you may not have to incur the debt at all, it's not a given that you marry the debt as well as the man.
I second the above answerer who asked why he doesn't file alone, so at least one of you won't be suffering from the consequences of the bk. on your credit report.
If anything, I would think about putting off the wedding, at least until he files for social services or if need be, chapter 7 bankruptcy.
If you do not have any debt I strongly urge you not to file jointly with him. He should handle it first. You'll be there helping him every step of the way, and you'll be in a better position to do so if you do NOT file.

Yes you could file chapte 7, but I would do it right after you got married so that if you did get any assests they wouldn't take them from you. You can also speak with an attorny for free and they will give you all the answers you need. One last thing I don't know what state you live in but in california we can go to the welfare office and file for emergancy medical and with that they look at your income, what your insurance has paid and your assests and then they determin what you can afford to pay and they pick up the rest. Now since you aren't married yet if your boyfriend went down and did it (you can get all the papers for him and help him fill them out) right now they would only look at his assest and income when determinning how much you can afford to pay. The medical would continue if he is still ill and seeing doctors. It could be a good thing and you pay for it already out of your taxes everybody does so don't be embarrased or anything just go do it. My husband sliced his two fingers almost off and had to have 3 hours of reconstructive surgery and physical theropy on his hand and Medical picked up all but like $400 of it. Then we set up payments with the hospital for the rest. Good luck to you.

You will be able to reestablish credit, but interest rates for cars (sounds like you might need one in the near future) will probably be very high.
