I just spoke to a lawyer last week about this. What the lawyer told us is that everything (the house) has to be out of her name for at least 5 years..otherwise, yes, the state can use the house to pay for her care. So if your mother trust you enough...have her "transfer" the deed into your name...This way she is not selling her house..
Oh..and even after transferring the deed, the state will still look at her assets for 5 years...So try to keep her home for 5 years after completing the transfer

why "legal" advice? If your mother needs nursing home care and has no way of paying for it, the selling of the house may occur. Why do you have nowhere to go? If you are only 58, I'm assuming you can still hold down a job?

My mother was in a similar position a few years back, she lived with my grandma and when my garandma had to go into a home my mother was told that she could remain in the house as she had contributed to the morgage and had lived there for a long time. However my mother was told once she moved out or died the house would be put up for sale and they would take their cut.

If your mother has no other means to pay for the care home then yes she will have to sell up.
Care homes are very expensive,If you are willing to look after her then It's a better option.

If it's being paid for my Medicaid, you cannot have transferred title to the property to anyone in the prior 3 years. If you were on the title prior to that, it's o.k. Contact Social Services--they deal with these issues all the time and will give you the information you need.

If I was you I would have her transfer the house into your name. You can easily go down to the court house and have her tranfer the deed into your name or buy it from her for a very reasonable price, say for a dollar, good luck

apparently the new thing is the gov.will sell the houses of those oldies to pay for their care.
Perhaps you mum should transfer the house into yourselves legally, in this case your mum owns nothing and the state has to pay for her care.
Remember, it is us who pay not out of the government's pocket.
