I am quite sure that would be their responsibility. It wouldn't seem fair for it to be your problem! Have you spoken with them about the problem? I would also make a phone call to your county or district and just check the laws for your area to be sure: if you could find out the absolute true answer, you'd look a lot better if a confrontation became necessary. Ohhh - we had this happen in my neighborhood. There was a tree clearly in one family's yard, but growing up around into their neighbor's yard and blocking their ocean view... So, one night the neighbor cut down all the offending branches (on the tree that wasn't his!) and I think pretty much killed his neighbor's tree. I just know that is NOT the way to go, because everybody was pretty upset, and the whole neighborhood found out about it, and there were legal threats and then general bad blood... and then tree-chopping neighbor moved away.
I'd say, whatever you do, make your neighbors a part of it. Be persistent if they try to blow your concerns off. Good luck!

In my area, branches that are over your property belong to you. You are allowed to cut or trim any branches that are over your property, as long as it is a 'good cut' (i.e. does not damage the tree).
Check with you local authorities to see what you are and are not allowed to do, but I think most areas in the USA have similar rules. If you are concerned about the tree falling onto your property and causing damage, then you need to tell your neighbor your concerns, if it does fall they are responsible for any damages.

the tree is property to the owner of the property in which the tree trunk is planted. Hypothetically, if the tree were to fall into and damage your house, you would have a legal right to sue for damages.
work it out with your neighbor.

I always thought that anything hanging on your property like that you can take care of. I do know that if a tree limb from another property is hanging over your roof and could cause damage then you have every right to cut it. I do not think they can be held responsibe for that.

Generally speaking, no you are not responsible. Some counties have weird laws, but they should actually be responsible to remove their tree from your yard. They should have been trimming it back so it doesn't hang over your yard. I would suggest that you buy a "home owners rights" book for your specific area and it should tell you.

Ask you neighbors if they'd mind if you trimmed the limbs from your side of the fence. If they are stubborn, then I believe there are certain laws that will allow you to trim it anyway. Check first so there wont be any trouble between you and your neighbors.

Ask them to please take care of the falling parts of the tree- and give your permission for them to come in your yard to do so. Friendly persuasion is always best. If that don't work throw the crap into there yard. if they don't like it, tell them to call a cop- see what he says.
