Is it discrimination when your boss openly shows that he doesnt like smokers knowing full well that you are one?

Yes!

Now, if your place of work still allows smoking and it bothers them or someone else, I think it's OK for them to have you take a smoke break someplace away from them.

I us to smoke for 30+ years but luckily quit 3-years ago.
Someone else smoking doesn't bother me.
What I would do depends on how they act. If they are nice about asking you to move I would move and try and not bother them.
If they are real A@@ Wholes about it and harassing you about it, I would report them to higher ups, and if they did nothing I would take it to a Lawyer.

It is discrimination. However, 1st of all, you must find out if it is because of your wrok that he dun like smokers. Or he jus hate smokers.
Is this sort of discrimination affecting your work? Did he still treat you like a staff or you are "another" staff? Being a boss, he must know that whether you are a smoker or not before he hire you. Moreover, he can't assess a person's work by knowing whether he/she is a smoker.
If you like the job, and your boss only have this prob with you, try not to smoke in front of him. Maybe you can talk to him peacefully and see what can be improved with you still being able to smoke and still do your job.
Lastly, (not to the question) smoking is not good to your body. Cut down on it and slowly quit it... It doesn't mean I hate smokers. Jus a word of advice...

Could be 2 reasons.

First, not a discrimination but sounds like a hint that he is getting fed-up with you because of something else. Your smoking is just a reason he can use.

Should check your situation at work. Has he been getting impatient with you or maybe anything you say or do is irritating to him? If there is a lot of tension at work then you should look for another job. Maybe he has turned to another employee as his favourite.

Second, if everything is fine with your work then he is probably concerned with your smoking and wants you quit. Maybe if you do quit, it shows your commitment to yr work too.

Yes it is but its but smokers are not a protected class so he is free to pick on smokers as much as he wants.

If refer to your smoking as an addiction then you maybe you have a case...

Actually your best option is stop smoking. You'll save money and feel better too.

No smoking is an action , he does not like smoker because they stink.

No I don,t think so he just may be worried about his health and every one else,s smoking has gotten a lot of attention and people are more worried about second hand smoke these days.

Maybe! try to smoke behind his back. Buy some "mints" sweets to kill of the smoke smell in your mouth. Observe him for a period of time, then sum up your case.
