My X moved out of town, abandonded our child, stopped paying support in March. He is working, I gave Friend of the Court his home & work address & phone number. FOC contacted him by mail to pay but my X refuses to pay, claims the FOC owes him money. Don't have money for an Attorney. FOC has all his info, why won't they go after him like they should? How can my X get away with this? My next step is to call his employer myself & inform them of the court order. How much longer do I have to wait? The law is if you don't pay you go to jail, or a warrant is out for arrest or drivers licenses will be suspended. How do I get the courts to ack faster? We have an investigational hearing w/ FOC in August. How can a father do this to a child?

There is no answer to your last question, unfortunately there are many fathers out there (as well as some mothers) that decide to move on with their lives and completely forget that they have a child that not only needs love and emotional support but also needs them financially!...... Well, you don't need to call the employer to advise them about the child support court order, the employer will not be able to do any garnishments until they receive the garnishment notice from the child support office-- What you must do is contact the child support office and tell them the name and address of the employer so they will send the garnishment notice... It is their responsibility to update their system and generate the letters.... After the notices of garnishments are sent out it usually takes between 3 to 6 weeks for the first payment to reach the child support office who will then forward it to you. Each employer is different and everyone does payroll differently so its hard to tell you exactly how long u have to wait-- As far as the warrant goes, it all depends weather or not your court order stipulates for a warrant for any missed payments. If your order does not have that stipulation then you must request for an enforcement hearing and request it in court. If he now owes you arrears you can request for a lump sum payment the day of the hearing, you must speak up in court and tell the hearing officer or Judge that this guy moved out of the city and chose not to pay for his obligations and you are afraid that he will not make his payments as ordered and you need that warrant stipulation to be put in the court order.

Unfortunately, it takes time for FOC to get all the paper work. They a huge job to do as there is allot of men that either don't pay or they refuse to pay.. Patient is the only thing that you have to hold on to.. Its sounds like the reason for him not wanting to pay is because he is mad or angry at you. Do you have a attorney, and if so is he doing anything?? As far as you having information on his whereabouts, that should have gone to the court clerk or FOC. What would happen if your friend didn't pass on your information and here you set waiting.. If and when you go to court don't be surprised if he calls into the court instead of showing up... As far as informing his employer that should have been done by the state. If the state has required the employer to send in his monthly support, then your ex-husband would not see that money because it is taken out by the employer's bookkeeper and then mailed into the state.. The employer may have already been notified of the problem. All I can is please have patients because the government works very s l o w l y.. I hope this helps in a small way....Good Luck..

First off do you go through a support unit locally? If you do then call them . If it is in NY use this number for Albany they will put you in touch with the right person for your area.1-800-343-8859.
I know exactly what you are going through, I am there and it is not a picnic. I just call his employer, file petitions with the court for non-payment, and call albany along with the county I live in. Psssst... they hate me but, I always end up getting it fixed each time because it is the law. Do not give up it is your child who goes without in the long run. You should also be able to file a petition with the court for non-payment and ask for paperwork to file for a lawyer. Most cases they will tell you that they will deduct like $25 a week from your child support. Just tell them you would like your X to pay all fees when he is found guilty. I did this and yes, Mr. X had to pay all attorney fees. There are lawyers that will work for free for you that take a portion of your payments owed but, the catch is you let them know that you want that reinbursed to you by making Mr. x pay you back . OOh.. you can also ask to collect interest for monies never recieved, ask for a judgement to be placed against him. In any case DO NOT give up. Make the deadbeat do his job! Call your state capital and find out who to talk to that is in charge of support for your county when the county is not doing anything. Good luck and remember DO NOT give up, Bottom line he pays up or is put up (in Jail).

Where do you live? What country? In the U.S. you can usually go to a county family court and they can help. However whether you have the money or not you would be much better off consulting a lawyer. If he has been ordered to pay and isn't and you get a lawyer he can also be ordered to pay all of your lawyer's fees as well. But the only way to do that is to hire a lawyer.

As irritating as it is, you have to be extremely pushy with the support office. Call every day if you have to. Push hard enough to get his license suspended. Then they move on to holding him in contempt (45 days later). The only problem is he HAS to be served with the paperwork. Unfortunately, there are quite a few men out there who walk away. I have one too. The court that usually does this is through the child support agency. Due to how many deadbeat dads they have out there, we have to wait forever. Good luck.
