Me and my boyfriend have a baby together. If we end up breaking up, how do I make sure that my baby stays with me? His name is on the birth certificate but we are not married. He works and I go to school. I get financial aid from school and I can get a job easy if I have to. My mom works part time and can take care of my baby. We can live with her. So, if we break up , how do I make sure my baby stays with me?

If you are not married ,you don't have a problem, matter of fact he has a big problem, in some states there are laws where who ever give birth to the child out of wedlock the child automaticly stay with the mother.the only out he has is proving it is his (DNA)

Oh you will get the baby the baby always goes to the woman if she wants it, it's how our messed up system works the father will have very little say in the matter except he will get dinged for child support for sure, why don't you be adult about it and work out a mutually acceptable agreement with him so he can be the father he needs to be and you can be the mother you need to be, and don't use the child as a weapon of leverage.

It used to be that the mother pretty much always got full custody but that is changing now, I know a few single dads with full custody. The judge will probably give custody to the parent who can supply the best possible living environment for the child to grow up in. Not necessarily who makes the most money but where there will be support and safety.

Contact an attorney and have him draw up some papers. Your attorney will need to advise you as to the custody laws in your state.

I would not rely on the baby's father to do the right thing. You need to be proactive and make sure your bases are covered.

Why are you thinking ahead,are you 2 having problem's? talk to him and see what he Say's..you could even get a signed agreement if you like.....try getting some legal advice first see what your chance's are! in any case from what i know,a mother has more right to stay with child until a certain age.. but the only problem would come in if you're financially unstable and aren't a good parent.. any way that's just my view..like i said seek legal advice and see what your chance's are....

Go to juvenile/domestic court and file for parental custody...Don't forget because if he gets mad at you and decides he wants to take the child there is nothing you can do because custody has not been established by either one of you.Please do not forget, the same thing happened to a friend of mine and the father took the the child out of state and filed in the state he went to and got it. She can only see the child by his and his new girlfriends' arrangement.

in Arkansas you got all rights to the child if you are not married he will have to take you to court and get a DNA test then the judge will decide what visitations he will get if he was abusive he will only get restricted visitations if he was a good father then he can get secondary every other week end and 3 weeks during the summer or something like that.

You are a female. 99% of the time you will get custody. Thats just how the system works. You have to totally screw up to lose custody. such as drug addiction, abusive to child, alcoholism, criminal record, etc. Just stay clean and you will be alright.

He is the father and you are the mother. You both have the same rights. The first thing I would do is to contact a Women's Center. They have counselors that can help and refer you to what resources are available to you. Everything is confidential.

Mothers generally have more rights when it comes to child custody.. if there is ever and issue you would need to document why you are the better parent.. and maybe why he would be a worse parent..
