when dealing with civil lawsuits, what is the term called when a lawyer will take a case, procede with a lawsuit and be payed after a the settlement as opposed to charging by the hour.

how do you go about asking an attorney will he/she do that?

Contingency. If they don't tell you up front about how they expect to be paid, you should probably find a new lawyer. At a minimum you should ask directly.

it is called taking the case "on contingency" meaning that on the condition that you win you split the proceeds of the award. if you loes he gets zero.
most attorneys will do this is a lawsuit for personal injury but seldom or never in a contract lawsuit. it is not permitted in divorce cases

It is called a contingent fee. All you have to do is ask the attorney if he/she offers that type of fee arrangement. The arrangement is quiet common for personal injury and debt collection cases. I offer both types of arrangements for my clients.
