If I am going thru a divorce and it isnt even final yet and my husband is getting a settlement for a drug he took causing him to get diabietis am I entitled to half? This is in Idaho and it was zyprexa.

If you knew the whole situation you wouldnt critisize me! Severe abuse to me and children. and no child support as of yet and i have been gone for 10 months already.

Since it's for treating HIS medical condition, you aren't entitled to it after you divorce.

Not sure about that, but according to some laws anything that was obtained during the marriage you are entitled to half. make sure that your lawyer knows this, call him and tell him so he can get the paperwork started. You may be. it's worth a shot though,.

Hope it does pan out and he gets a huge settlement and you get the half! Laugh all the way to the bank girl!

there are too many variables that you have not disclosed for me to give you any substantive suggestions.

Generally this type of settlement is not subject to the community property laws since it is a settlement from a law suite and is intended to compensate a victim for their injuries from the drug. You were not the injured party so you are not entitled to any part of the compensation.

Depends on whether you are in a community prperty state and a lot of other things. For instance if this reimburses him for medical bills paid out of your combined income, you should get some of it. Likewise if he mised a lot of work and you had to support him. Talk to your lawyer.

Let the man suffer in peace with his well-deserved restitution. He's the one with diabetes, not you. This is an area where you should rely on what's right, not what the law says you can get.

I see this divorce is a good thing.
