I know some girls that were molested 40 years ago and are still suffering from it. can they still sue? it happened in colorado but the girls and molestsr are now in california

There is some tricky legal stuff involved and it is best to consult a lawyer. There is an issue about the statute of limitations, however, there are loop holes regarding memory and such. That is why you should talk to a lawyer. Basically, you can sue for anything, but do you have a case, is the question. Criminally, you are bound by limits too. I do not know what these are, and if they vary from state to state, or whether you can charge him/her in the state of the crime...etc....

I DO NOT KNOW HOW THE LAW IS IN COLORADO OR CALIFORNIA, BUT IN MISSISSIPPI IF THE MOLESTED ONE DOES NOT FILE CHARGES BEFORE THE AGE OF 21 THERE IS A STATUTE OF LIMITATIONS WHICH PREVENTS THE MOLESTED ONE FROM HAVING ANYTHING DONE TO THE MOLESTER LAWFULLY. IN MY OPINION THIS IS TOTALLY 'NOT' MORALLY RIGHT. BUT IT IS THE LAW HERE IN MISSISSIPPI. MY HEART GOES OUT TO THE GIRLS THIS HAS HAPPENED TO IN A BIG WAY!
AND I PRAY FOR GOD TO HELP THEM THROUGH THEIR PAIN AND SUFFERING! MUCH LOVE!
AND INSTEAD OF A DEATH SENTENCE OR A FEW PRISON YEARS FOR THE MOLESTER. I THINK THE CHILD MOLESTERS SHOULD BE CASTRATED COMPLETELY AND THEN PUT IN PRISON TO SUFFER OUT THE REST OF THIER LIVES WITH NOT BEING ABLE TO HAVE SEX AT ALL!!!!!!!!

Sure they can. Look at all the priests who got sued by children who grew up to sue them. It happens all the time.

If the Catholic church can pay out 6.5 million dollars in Missouri alone - for sex abuse that happened in 1969, then you can bet your butt that someone can sue 40 years later.

Was it a priest or a teacher?

i think you can but if it is 40 years later i don't think it will accomplish much. The person probably won't remmeber as much about it. The court will probably be less likely to punish the person that longer afterwards. I say go for it just make sure you have evidence and other things or else all it is, is a waste of time and money. Try to forget it.

I know of a similar circumstance here in Victoria Australia. It is difficult but is not impossible here. I know of another case in the USA, sorry I do not remember which state. Victim got lawyer to write and threaten legal action even though it was not viable. Anonymous friends of the victim started to progressively make his crime be known, to employers, leafletting neighbours, etc. Molester paid up rather then having his life destroyed. Not exactly legal, but a form of justice.

You can try but you need alot of witnesses ppl who were also molested or else your case is going no were. It happened to me. I was molested when I was about 8 yrs 10yrs later I tried to put the criminal in jail but I lost because I didn't had any proof or other witnesses. I did had another friend who was molested by him but she didn't help me because her mother was going out with him and she was living in her house so, it was save me or save herself. When the detective went to her house to talk to her she denied everything, leaving me like some poor liar. I would never forget how the police never helped me. I am still holding that grudge because when I went for help they didn't do anything and left him go free. That man now lives with my ex friend's mom and she has a daughter of 12yrs and my ex friend has a daughter of 1yr. WTF how can she even stand to live in the same house with the same man who molested her???? He will pay for this dearly sometime in his life because Karma's a b*tch.


Oh yes I almost forgot. I didn't even had a trial because the Jurys decided that I had no case. Talk about having Justice.

if ur the molester... 1 advic 4 u ... U WILL GET CAUGHT NO MATTER WHAT

If you mean civil suit, I would think yes. There may be, however, a statute of limitations on criminal charges. Civil suits following a criminal conviction are usually a slam dunk (collecting a judgement is another matter.)

I hope so. I hope they can be sued 100 years later. They should all just be sentenced to death.

yes u can sue him wid sum of his current records of molestin or wid sum proofs . y dont u get confirmation frm a lawyer
