she barely decided to use it and they have been divorce almost a year. she didnt use it right after they got married and she also did not change it until now.

If you are referring to your former spouse, probably very little.

Does the divorce decree officially restore his/her former name? If so, one has to wonder why they would continue to use your surname.

You didn't give many details about why this is bothering you. If you feel they are opening credit in your name, you should obtain a credit report for yourself by contacting all 3 of the major credit bureaus. They are required to give you 1 report per year at no charge. You will pay a nominal fee for additional report. Examine the reports closely to see if there has been credit granted that you don't know about.

IF he/she is obtaining credit with your name as well, you need to contact your law enforcement authorities and file a report of identify theft. This is highly illegal and DOES land people in jail. Then, immediately notify the credit bureaus that you are divorced and request a fraud alert to be placed on your account. This will notify you when anyone attempts to establish credit in your name and will flag your credit account for closer scrutiny.

You can't. Once a woman marries and take the man's name, she has the right to keep it. It is now her last name too.

I kept my married last name because I felt it was important for my children to have the same last name as their parents.

File a complaint in court to prohibit using your last name due to valid reasons and considering that you are already divorced.

If that person was married into the last name and used it, legally the is nothing you can do, legally it is their last name! Sorry!!

You can pay the fees to have their name legally changed, new licenses etc. not cheap.
