Is it possible to have my childs name changed to his fathers last name even though his father is not living in america and is not on the birthcertificate? I know I have to go through the courts and name changes cost money, but is it even possible if the father can't consent legally?

Thanks so far, his father just wants him to have his last name but he won't risk coming back here.

Without his legal consent you would have to prove paternity then petition the courts for the name change.

Yes, just go to the courthouse, and get the paperwork.

You did not say how old the child is, but if they are old enough (12+) they will have to be sworn in and stand in front of a judge. The judge will ask "are you changing your name for illegal or immoral (something to that affect) purposes?" They answer "No" and you are done.

If the child is too young, you may have to stand before the judge instead. The clerk will explain it all to you.

If you wanted to change the name to 'Smith' you wouldn't need permission from every 'Smith' in town. Changing your child's name has no legal impact on the father.

You can give yourself or your child any name that you want. You don't need any consent. Just court cost and attorney fee etc.

Outta curiosity, can't you, as the mother, change your child's name to whatever it is you want? Anyhow, where there's a will, there's a way.
