AYE MATEY!! Oh yes, there are indeed modern day pirates!
Blackbeard, Treasure Island, and Captain Hook may come to mind when you think of pirates. From the Pirates of Penzance to the Pirates of the Caribbean, we have seen plenty of romanticized images of these maritime bandits from days of old. But modern day pirates are alive and well...and I don't think they have eye patches and peg legs.
In reality, piracy is flourishing from Sumatra to Somalia, and today's pirates are far from the lovable rogues who populate swashbuckling movies like the new Pirates of the Caribbean: Dead Man's Chest.
There were 276 acts of piracy in 2005, 329 in 2004, 445 in 2003, 370 in 2002, 335 in 2001, and 469 in 2000. The attacks in 2005 resulted in 404 crew members being taken hostage. Twelve are still missing.
Low-end pirates may not be interested in the cargo being transported. Instead they will board a ship and hold up the crew long enough to steal the large amounts of cash that many ships carry for payroll and port fees.

Take it from someone who lives in Florida, YES pirates are alive and unfortunately doing quite well, news reports of vessels being hijacked, some for drugs, some by druglord pawns when the pirates evade the US Coast Guard.
In any open water if a vessel is taken by force the term is called Piracy.

Piracy is robbery committed at sea, or sometimes on the shore, by an agent without a commission from a sovereign nation. One who commits piracy by engaging in robbery, pillaging, or plundering at sea is known as a pirate. While boats off the coasts of South America and the Mediterranean Sea are still assailed by pirates, the advent of the United States Coast Guard has nearly eradicated piracy in American waters and the Caribbean Sea.

Yes, there are real pirates out there. Nowadays, they tend to have expensive high powered speed boats and are heavily armed. There have been several documentaries about many of these pirates on the Travel Channel and on Discovery. There were several instances reported in the news just a few weeks back. I'm sure if you do a google search you'll find a lot more info.

Oh yeah.Down in Central and South America where there's still allot of civil unrest, guerrilla warfare and all that , the guerrillas have been known to take to the water and raid ships.So I guess that counts as piracy.

Yes, there are, especially off the coast of Africa. The Discovery Channel airs shows about them sometimes.
