You were able to pay $25,000 for a retaining wall in your back yard? Maybe you should have taken your chances with the earth... But I am sure you can sue him. It is the American way.

You need to establish why the wall is falling over. If it is from something that wasn't forseeable, you may be out of luck. If it is from just plain shoddy workmanship, you probably can make a good case.

Get a lawyer, get a dependable, trustworthy, knowledgeable third party to inspect it and determine if the cause was faulty construction or materials. If so, sue the hell out of them.

I would suggest calling the contractor to come and look at the problem and determine if they feel they can correct the problem before you jump to suing...but maybe you already did that.

if you're in BC you need an Engineer to okay any wall over 1.2 meters tall.(the builder would know this an he's on the hook)

It might be similar if you don't live in BC

small claims has a cap - probably around 5k. call a lawyer, but then you have their fee. check your contract and contact the contractor.

If you can sue someone for looking like you, then you can sue someone for that.

You should have some kind of guarantee, check your contract, if you don't have it, there is not many things you can do.
