No, the consumer should bear some of the responsibility, since it is something beyond the control of the company that sent the package. Plus, how can a company know for sure if the package was stolen or if the consumer is just trying to get a free item.

Yes that happened to a watch I bought. I happened to catch the fedex guy just before he pulled away from my house and he called it in and I reported it to overstock.com and they sent me a new one.
