neither of the previous answers are correct. Lincoln only "emancipated" the slaves in the states that were in rebellion (IE the confederate states). After the Emancipation proclamation took effect in January of 1863 there were still a few states in the Union (small parts of Delaware, Kentucky and portions of Missouri) where slavery still existed. The slaves in the US were not ALL officially free until the ratification of the 13th amendment of the US Constitution in 1865. "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. " The president at the time of the ratification of this amendment was Andrew Johnson.

He didn't. President Abraham Lincoln did. He signed the Emancipation Proclamation in 1863. By 1865, all the slaves were freed. The 13th amendment of the United States Constitution, ratified in 1865, made slavery illegal in the United States.
