I paid deposit to secure this apartment in CA, but 20 days before move-in date, I changed my mind and decided not to move in. So I never take possession of the apartment. This is a very popular apartment, and I believe my blank will be filled in right away.

The problem is I signed one sheet of agreement when I paid depoist, it says if I withdraw the application after 72 hours, my deposit will be forfeited. And it's already more than 72 hours now. Is that legal agreement? Can I still get my deposit back?

Thanks.

The agreement you signed is legal and binding. You are out the money.

People must learn, when you sign a legal document, you cannot get out of it....They held that unit for you and didn't show to other prospective tenants. Why would they give you your money back when they probably could have rented it a number of times?

It's legal and binding. Sorry. Expensive lesson learned.

probably not. according to the terms you forfeit the deposit. you can ask nicely and see if they will give it back but don't get your hopes up.

Unfortunately, since you signed that you are out your deposit. If that is what it says then that is what it means.
