Okay. People on MySpace get drunk, have sex, so on so forth, and put up pictures. And they get mad when someone uses them.

If they didn't want anybody to use them, don't put them up; or put the profile on private. Amen?

For my personal opinion, I think it is silly to post such pics online and risk having somebody swipe it.

Legally, however, the author of the image owns copyright. Publishing an image online or through other media does not make the image free for anybody to use. If somebody takes the picture and reproduces it without the permission of the author, they are violating the copyright. You do not have to file for a copyright or provide copyright symbol to hold copyright.

From the U.S. Copyright Office:
"Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work. Only the author or those deriving their rights through the author can rightfully claim copyright."

"No publication or registration or other action in the Copyright Office is required to secure copyright."
