My son died unexpectedly and left no will. He was single, 22 years old. He has money in his bank account and a paycheck that we are unable to cash or put into his bank account. He also has a car that is in his name that we would like to sell. We, my husband and I, paid for all of his funeral expenses ourselves, which we had no second thoughts about. However he still owes some money on his credit cards, and those are his only debts. We are also still looking into the possibility that he may have had some type of death benefits.

It depends on the state, but generally a person's estate who dies without a will goes to probate and in many states the next of kin (wife or children, if married) or parents if not. It may leave the estate a litle more tax exposure, though...

Yup, hire an attorney. Presumably the issue MUST
be resolved by the time of probate and unless
you have someone contesting (say, another
parent, a wife you didn't know about, etc) it should
be pretty simple.

Wait for the death certificate to come in. Then you go to an attorney and petition the court to become executor of the estate

A lawyer can help you get through probate and most wont charge very much!
