My daughter's father and I split up when i was 2 months pregnant because he was doing drugs and robbing people and I wanted my daughter to have a better life than that. Of course I gave him the opportunity to chance but he didn't. He went to prison in January and my daughter is now 15 months old. She has never met him or his family. Though, we do get an occasional letter from him asking for pictures, a visit, etc. We have never recieved money (not that I have asked or want it). Her father will be in prison for roughly 6 years. I would like to have his rights terminated but don't know where to begin. We live in South Carolina, and hopefully someone out there will have some advice for us.

I would assume that it is the same or almost the same in most states. You are going to have to get a lawyer and petition the courts. Or an attorney can draw up the papers and IF your child's father agrees and will sign the papers then you can do it that way, which is alot easier and cheaper.

I am in the same situation (almost) except that I am a grandmother with custody of the child and her father is in prison ( for the next 25 yrs) and the mother just didn't want to raise the child without a father.
I am trying to get enough money together to hire an attorney and petition the courts for both parents rights to be terminated.
Neither of them help in any way, and neither parent has anything to do with the child. I have had her since birth and I am the only mother she knows.

I don't think that you can terminate his rights to see his child or parent her. I think that he would have to relinquish them which means he signs a paper stating that he no longer wishes to have guardianship of her. In the mean time you could build a case as to how he is an unfit parent and go to court for full custody of her. I think you would be doing her more harm though if you don't give her the option of knowing her father then when she's older she can formulate her own opinion of him. Just be sure not to allow her visitation with out being present you never know what he could be capable of. Good Luck

I understand your situation, but I doubt that you can terminate his parental rights just because he's in prison. No doubt you can acheive sole custody however. When he's released he'll have to petition the courts if he wants to see or have any contact with the child.

I'm sorry if your in a difficult situation, but you slept with a drug addicted robber and got yourself knocked up. Live with it. Good luck.
