Trouble with whom? The subscriber or the ISP? If the subscriber allows it there isn't much anyone can do about it.
If you are accessing the Internet via a wireless router, the owner should restrict you or you can assume it's probably okay.
Legally? I'm no lawyer but if you are not doing anything illegal otherwise, I don't see that it's anyone elses business!

Technically, if you have free access to the network, then it's the neighbor's fault for not putting a WEP or WPA on it in the first place. However, if they catch you, you could get them seriously P.O.'ed. Then they'd definitely get a WEP or WPA on their network. Just try to not use their network unless it's absolutely nessicary (That exludes IM). If it was password-protected and you got on it, then your computer or you decoded it and suddenly, you're a criminal. Hacking is a crime, as far as I know.

Well, in theory you could be arrested for "theft of property/services" (or whatever your state may call it)
What degree (Misdemeanor/Felony) would depend on how much the service costs and how long you have been stealing it.

If it is an open wireless network, anybody and everybody can access it and they shouldn't have set it at open. If not, then you did something you shouldn't have to get access. Why don't you just offer to split the fee with them and share it?
