If a person was to rob a fast food restaraunt at gun point, but in addition to demanding money, demanded a hamburger fries and chocolate shake, could he come back and sue the establishment if he found out that the person who prepaired his food spit in it?

In the Uk we get the impression you AMericans will sue anybody for anything - so it wouldnt suprise me!

That's a pretty interesting question. I think if he wanted to sue for having someone spit in his food, he would at least have to have a receipt or proof that he did order the food. But he doesn't really, because he stole the food, so, I guess my answer would be that he could try... he wouldn't get very far though...

In our society -- most likely. Sort of like the burglar who sued a homeowner after he got locked in their garage for a week without food (somehow the homeowner was supposed to plan on being robbed, plan on the robber being dumb enough to be locked in the garage, and then plan to feed said robber). The burglar actually won that case!!

Although, spitting in a burger doesn't actually cause HARM, so he might have a harder time. If the burger made him SICK, he would have a better case.

That's like the story of the Marine on the airplane sitting in the aisle seat next to an Arabian . When he got up to get a drink from the air hostess, the Arab spit in his shoe.
When the Marine came back to his seat with a Coke, the Arab sitting next to him said he would like a Coke too. The Marine said, I'll get it for you, I'm on the aisle seat.
When the Marine left to get the Coke, the Arab picked up the Marines other shoe and spit in it.
When they were landing, the Marine went to put on his shoes and knew immediately what had happened.
He said, "How long is this going to go on, you Arabs spitting in Marine's shoes and Marines pissing in Arab's Cokes?"

Arguably this is the stupidmost question i have ever seen. But well he should have the right to sue the spitter, provided he has robbed a reciept as well...

No, the goods you got were gained illegally, therefore you have no claim! Just like you would have none if you were killed in the middle of a robbery!

The ACLU takes CONSTITUTIONAL issues for the idiot above who is showing his ignorance. Just hate to have poor people have their day in court, don't you?

ummm... yes, I think he could sue... But then the place would be able to catch him and at least get their money back that he stole. As far as would he win? I don't know..... I guess it depends on who he got for a lawyer!

sure, you can sue anybody. He wouldn't win, though. They have a rule where you have to come to court with clean hands, which means, no crime on you. Can't sue a drug dealer for ripping you off...

absolutely he could sue and would probably win. there are countless cases of criminals suing their victims or families and winning...its incredible to believe but true...it seems there is a website that discusses this but i am not sure of the address...just do a websearch for it
