I have a lemon law case against Nissan. Last March, a Nissan representative sent a letter to my attorney offering me $3000 to settle the case. It appears the problem I was having with my Armada has been finally resolved. Now, I really want to get the $3000 they are offering. My question is, should I have my attorney contact Nissan to send me the payment or should I contact the Nissan rep directly without advising my attorney? I'm afraid that if I contact my attorney first, he'd ask for payment from me as well. Any ideas? Thanks.

I would say to talk to your attorney first. He may advise you not to settle for the $3000 they are offering and seek something larger.

I would advise you to go through your attorney since you have been working with an attorney throughout the case. The attorney may take a percentage of the money, but if you screw an attorney over, they will come after you personally. I would advise you not to try to do anything under the table as that could come back and bite you in the a*s!!

You can always seek free legal advice. Many lawyers (surprisingly) are kind enough to offer you a few minutes over the phone to advise you of your rights, and what would be in your best interest. I had a similar situation, talked to a lawyer for a few minutes, and settled my case. Make sure when dealing with Nissan you make it clear you have sought out legal advice, and are prepared to make your case heard (even if you're fibbing a bit). That should be enough pressure for them to settle, no questions asked (and for Nissan, $3000 is chump change anyway). So, if you're satisfied with the proposed settlement, contact them yourself, making them fully aware you have sought legal advice. Then sit back and wait for your check.

I use to work for Infiniti and the QX56 had the same problems. The problem is that the new plant these trucks are made at have unskilled workers for car manufacturing unlike if they would of built it in Michigan to replaced the outsourced U.S. car plants. I bet the motor and transmission have no problems. I could list alto of problems with the truck which are not safety issues but overall Nissan is a great company.

If your attorney did any work on the case he deserves payment! Since you have an attorney on retainer and the letter was sent to their office, it sounds like they did some work and deserve payment. So my suggestion is to pony up. You are lucky you are getting any money and you should pay!

I think I would research it more and counter offer Nissan before I saw an attorney.

LOL! $3,000? First off, hell no. The lawyer would probably get, oooh, about 2/3's of that. Pssh, do you have any friends that are good at pretending to be lawyers? Call Nissan up! Get the head people on the phone, and let them speak to your 'lawyer'. They wouldn't want things to get ugly. You could also contact news outlets to tell them about this. They always like good juicy news.

You're going to have to pay your atty anyhow, since he is already involved, and he deserves to be paid for his/her services. Plus, he would have a better chance of landing the 3G.

contact your attorney and you will have to pay him, but becare about keeping it from him cause if he finds out he'll bill you....
