Yeah! That was utterly ridiculous that she got off. How do you wait until your husband leaves (shows premeditation) drown 5 kids (one at a time), call 911, and still be able to claim insanity. Justice was not served for those 5 children. I just hope that she got what was coming to her every day that she was in jail.

In the US legal system, it's the burden of the prosecution to prove that Andrea Yates was guilty beyond a reasonable doubt. In this case, Andrea Yates had a solid defense team. In the end, Andrea Yates will face judgement before God.

Andrea Yates is "Insane" ..a mother who does that or any person that does ...is not Sane...that person loses all senses and their mind...She said she committed those crimes because God told her...Psychiatrists said that when she said that ...she knew what she was doing...but I seriously doubt that...With this new trial she was proven "Insane" ...due to the fact that she told a fellow inmate that "there are ways of claiming insanity" That woman will never see the outside world again...she is committed for Life. She will meet her maker and get her Judgment then...

The problem is, people trust in the excuse of disorders a bit too much. There seems to be a disorder for everything these days... and I don't buy it. The pharmaceutical companies and the medical communities have made a "killing" on new drugs to treat EVERYTHING from "restless leg syndrome" to "being an active child". And our society puts a little too much trust in them. We forget, they have to get paid too. And with all the new disorders popping up, that gives us a whole new world of excuses to not be held responsible for our actions.

Just because she's insane doesn't mean that she didn't know what she was did was wrong. Her own testimony shows she knew what she was doing. I think she should have been found guilty and her punishment should be harsh, but she does need some sort of psychiatric care, like medication.

Of course she was insane, what normal person would kill anyone, let alone their own children. She should spend the rest of her life in prison, and she deserves our pity, and her children deserve our prayers. Post partem depression is a very real phenomenon. Dr's need to educate themselves and the public on the identification and treatment of post partem depression.

I don't believe in "Innocent by reason if insanity", only "Guilty by reason of insanity" and I believe she should be put away forever and punished accordingly.

Of course she's insane, who else kills their kids besides an insane person.

I think she was definately insane and needs to be in a mental hospital, but I don't think she should have a chance to get out. They should keep her locked in there forever, since they can't kill her because she was insane.

It used to be that you could only get off by reason of insanity if you didn't see that what you have done is wrong...but she DOES! She admits to what she has done and although she does not wish to take it back, she knows that it was murder. i have no idea why they bent the rules for her. Why not send her to prison with psychiatric evaluations there?
